1. Activity Risk Disclosure
Participants acknowledge and understand that badminton involves certain risks, including but not limited to:
• Muscle strains, sprains, joint injuries, etc., that may result from rapid movements, jumping, and swinging motions.
• Scrapes, bruises, falls, etc., that may result from collisions or contact with other participants.
• Slips, falls, etc., that may result from wet courts, defective equipment, etc.
• Accidental injuries that may result from poor physical condition or insufficient warm-up.
Thank you for choosing Markham Badminton. Markham Badminton has taken reasonable safety measures, including but not limited to providing standard courts and equipment, and providing necessary safety reminders. However, participants must fully recognize the aforementioned risks and assume corresponding responsibility.
2. Assumption of Risk and Release of Liability
Participation in badminton involves physical exertion and carries the risk of injury. You are aware that there is potential risk for bodily injury, including death, disability, and dismemberment, as well as the risk of damage to or loss of property while participating at Markham Badminton's facilities. While abiding by the rules of sport, wearing proper attire and equipment, and maintaining discipline may reduce these risks, such risks do exist.
You knowingly and freely assume all such risk. You hereby release, waive, and discharge any and all claims, liabilities, or demands that you have now or may have in the future against Markham Badminton, its directors, officers, employees, representatives, and other players ("Releases") for any loss, damage, injury, or expense, including those resulting from the negligence of the Releases, condition of the premises, breach of contract, or breach of any statutory or other duty of care.
3. Medical Authorization
In the event of an injury or emergency, I authorize the staff of Markham Badminton Club to provide or seek necessary medical treatment. I understand that I am responsible for all medical costs incurred as a result of participation.
4. Court and Course Usage Statement
• Rule Compliance: All participants must strictly abide by the venue's usage rules and safety regulations.
• Court Maintenance: Markham Badminton will exercise reasonable care to ensure the safety of the court facilities, but participants should inspect the court conditions themselves and pay attention to safety.
• Anomaly Reporting: If any abnormality is found on the court, venue staff should be notified immediately. If no notification is given and the abnormality is one that a reasonable person could have discovered, Markham Badminton shall not be liable for any resulting accidents to the extent permitted by law.
I agree to follow all club rules, respect coaches, fellow participants, and facilities, and conduct myself in a safe and sportsmanlike manner.
5. Training Course Disclaimer
Students participating in adult or youth badminton training courses should follow the coach's instructions and train within their own capabilities. Markham Badminton shall not be liable to the extent permitted by law for damage caused by failure to follow the coach's instructions or training beyond one's own capabilities. Guardians of minor students should carefully read this statement and bear the corresponding supervisory responsibilities.
To the extent permitted by law, except for personal injury caused by the intentional misconduct or gross negligence of Markham Badminton, Markham Badminton shall not be liable for personal injury or property damage to participants caused by the following reasons:
• Damage caused by the participant's own fault, including but not limited to:
◦ Failure to comply with venue rules or follow coaching instructions.
◦ Improper use of the court or equipment.
◦ Concealing one's own health condition or failing to warm up adequately.
◦ Improper operation or insufficient skill level.
• Damage caused by the fault of other participants or third parties.
• Risks resulting from normal wear and tear or reasonable maintenance of the court or equipment, such as minor unevenness of the court or worn equipment.
6. Image and Video Release
I grant permission for Markham Badminton Club to use photos or videos of me/my child taken during club activities for promotional purposes, including on social media, websites, and printed materials.
7. Parental Authorization of Child Dismissal (For Participants Under 18)
I hereby give permission for my child to be dismissed from the badminton training classes at the conclusion of the scheduled session, regardless of whether I am present at the time of dismissal.
I understand and acknowledge the following:
• Scheduled Class End Time: Classes will end promptly at the designated time as communicated by the club.
• No Supervision After Class: If I am not present at the end of class to pick up my child, I understand that the club and its staff will not be responsible for supervising my child after dismissal.
• Parental Responsibility: It is my responsibility to ensure timely pickup of my child. I will not hold the club, its staff, or volunteers liable for any injury, incident, or harm that may occur once the class has ended and the student has been dismissed.
• Emergency Situations: In the event of an emergency or unexpected delay in pickup, I will make all efforts to contact the club immediately.
By selecting "I do not authorize my child to leave independently", parent acknowledge the additional following:
☐ I do not authorize my child to leave independently. I or an authorized adult will pick up my child on time.
• No Curbside Pickup: I understand that children must be picked up from inside the facility. The club does not permit children to walk unaccompanied to the parking lot or wait outside for pickup. If my child leaves the building without being escorted, I understand that the club is not liable for any incidents or injuries that may occur outside the facility.
• Late Pickup Policy: In the event I am delayed, I will notify the club as soon as possible. However, I understand that the club does not provide after-hours supervision and is not responsible for my child beyond the scheduled class end time.
